Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Amplifye Brand Limited Company ("Amplifye," "FeedFuel," "we," "our," or "us"). They govern your access to and use of the FeedFuel mobile application, website, content tools, and related services (collectively, the "Services").

By creating an account, connecting an Instagram account, purchasing a carousel pack or subscription, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and authority

You must be at least 13 years old to use FeedFuel. If you are under the age of majority where you live, you may use the Services only with permission from a parent or legal guardian.

If you use FeedFuel for a business, organization, client, or other person, you represent that you have authority to accept these Terms and connect or manage the applicable Instagram account and content on their behalf.

2. What FeedFuel provides

FeedFuel provides tools that may help you:

• Connect an Instagram Professional account.
• Connect a TikTok account to view your profile and video performance and to publish content at your direction.
• Analyze a profile, posts, and available performance information.
• Save Brand Knowledge, source links, and creative references.
• Receive content recommendations and plans.
• Generate or edit captions, scripts, images, carousels, infographics, videos, and other materials.
• Save, schedule, or publish content at your direction.
• Review performance and use it to inform future recommendations.

The web carousel maker is a standalone creation tool. You can use it without connecting Instagram. Mobile features and subscriptions are separate; a web pack does not automatically include mobile subscription access or transfer its allowance to a mobile plan.

Features may vary by platform, account type, location, subscription, permissions, provider availability, and product version. We may add, change, limit, suspend, or discontinue features as the Services evolve.

FeedFuel is a content planning and creation tool. It is not a guarantee of followers, reach, engagement, sales, revenue, virality, or any other result.

3. Your account and Instagram connection

The web maker uses Firebase authentication to create or sign in to your account. If you choose to connect Instagram in the mobile app, FeedFuel uses Meta’s authorization process for the Professional account you select. You are responsible for:

• Providing accurate information.
• Maintaining control of your device and connected accounts.
• Keeping your login and recovery information secure.
• Ensuring you have permission to connect the account and access its content and insights.
• Promptly notifying us of suspected unauthorized access.

You may not connect, analyze, or publish to an account you do not own or have authority to manage.

Your ability to use Instagram-related features depends on Meta's APIs, permissions, account requirements, rate limits, reviews, and policies. Meta may change or withdraw access at any time. FeedFuel is not sponsored, endorsed by, or affiliated with Instagram or Meta.

If you choose to connect TikTok, FeedFuel uses TikTok's authorization process for the account you select. The same responsibilities apply: you may connect only an account you own or have authority to manage. TikTok features depend on TikTok's APIs, permissions, review and policies, which TikTok may change or withdraw at any time. FeedFuel is not sponsored, endorsed by, or affiliated with TikTok.

You may also sign in to FeedFuel with Sign in with Apple. Apple may give you the option to hide your email address; if you do, we receive a relay address from Apple.

4. Web packs, subscriptions, billing and cancellation

One-time web carousel packs

The web carousel maker offers a limited free allowance and paid one-time packs. The number of carousels, price, currency and any tax are shown before you confirm purchase. A web pack is a consumable allowance, not an auto-renewing subscription; it does not refill or charge you every month.

One carousel generation uses one available carousel. Manual editing and downloading a saved result use no additional generation allowance. Other AI tools, such as targeted rewrites and image descriptions, have the separate limits displayed in the service. Current supported slide counts, import limits and included editing options are shown in the builder. A deliberate new generation uses another carousel.

Web checkout is hosted by RevenueCat, with payment processing by Stripe. Use the same FeedFuel account for checkout and generation. A purchase is added after the provider confirms it; returning from checkout alone is not confirmation. Contact support@feedfuel.app if a confirmed purchase does not appear. Keep your receipt, but do not send full card details or passwords.

A failed generation restores its generation allowance; confirmation and recovery can take time. Restoring an allowance is separate from a refund of money. For a web billing error, an undelivered purchase or a refund request, contact support@feedfuel.app with your account email and receipt reference. Requests are reviewed under the circumstances of the purchase and applicable law. Nothing in these Terms excludes mandatory rights concerning faulty or undelivered digital content, cancellation, refunds or other consumer remedies.

Purchased web carousel allowances do not expire while your account remains active. They are attached to the account that bought them and are not cash or a transferable currency. We do not promise that a web allowance can be redeemed in the mobile app. Account deletion may make unused allowances inaccessible; contact support about an unresolved purchase or refund before deleting your account. This does not restrict your privacy or statutory consumer rights.

Mobile subscriptions

Some mobile features require a paid auto-renewable subscription. Prices, billing periods, included features, and any introductory offer will be shown before you confirm a purchase.

If you subscribe through Apple or Google:

• The applicable app store processes your payment.
• Your subscription automatically renews unless you cancel through your app-store account before the renewal deadline shown by the store.
• Your app-store account will be charged according to the price and billing period displayed at purchase.
• You can manage or cancel the subscription through your Apple App Store or Google Play account settings.
• You can use FeedFuel's Restore Purchases control to restore an eligible purchase.
• Refunds are handled by Apple or Google under their policies, except where applicable law requires otherwise.

Deleting FeedFuel does not cancel a subscription. Deleting your FeedFuel account also may not cancel an active app-store subscription. Cancel the subscription through Apple or Google before deleting your account if you do not want it to renew.

FeedFuel does not promise a permanent free tier or free trial. If a trial, discount, or promotion is available, its duration, price after the offer, and other material terms will be displayed before purchase.

We may change subscription pricing or features prospectively. The applicable store will provide notice or request consent when required.

iOS App License

Use of the FeedFuel iOS app is governed by Apple’s Standard End User License Agreement (EULA).

5. Your content

"Your Content" includes prompts, messages, profile information, Brand Knowledge, source materials, uploads, media, captions, plans, and other content you submit, connect, create, or publish through the Services.

As between you and FeedFuel, you retain your rights in Your Content. You grant FeedFuel a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify, transmit, display, and create technical or generated derivatives of Your Content only as reasonably necessary to operate, secure and provide the Services you request. This does not grant us permission to sell your private source materials or publish them as marketing examples without your permission.

This license permits us to send necessary inputs to service providers that host data, process media, generate content, deliver notifications, diagnose errors, or otherwise support FeedFuel. It ends when Your Content is deleted from our active systems, except for limited backup, legal, security, and operational retention described in our Privacy Policy.

You represent that:

• You own Your Content or have all permissions needed to use it with FeedFuel.
• Your Content and instructions do not violate law, another person's rights, or a platform's terms.
• You have permission to use any names, likenesses, music, trademarks, confidential information, testimonials, claims, and third-party materials included in Your Content.

6. Generated content and AI features

FeedFuel uses artificial-intelligence providers to analyze information and generate recommendations or creative output. AI systems are probabilistic and may produce inaccurate, incomplete, offensive, outdated, or similar results. Importing a webpage or PDF does not establish that its contents are accurate or that you have permission to reuse them. Image descriptions and comparisons can be mistaken; review labels, claims and context before publishing.

You are responsible for reviewing, editing, fact-checking, and approving generated output before you use or publish it. Do not rely on FeedFuel as a substitute for professional legal, financial, medical, tax, or other regulated advice.

Subject to applicable law and third-party rights, FeedFuel does not claim ownership of the output generated specifically for you. We do not guarantee that an output is unique, eligible for intellectual-property protection, or free from similarity to other material.

You must ensure that published claims are truthful and substantiated and that your use of generated content complies with advertising, endorsement, copyright, trademark, privacy, publicity, and platform rules.

7. Publishing and scheduling

FeedFuel publishes or schedules content only at your direction. You remain responsible for the final content, selected account, caption, media, timing, disclosures, and compliance with the rules of the platform you publish to, including Instagram and TikTok.

Publishing and scheduling can fail or be delayed because of expired permissions, account restrictions, internet outages, provider downtime, rate limits, platform changes, unsupported media, processing errors, or other conditions outside FeedFuel's control. We do not guarantee that a post will publish at an exact time or remain available after publication.

Review each post before scheduling or publishing. If a scheduled item is important or time-sensitive, confirm its published status through FeedFuel and Instagram.

Content published to TikTok is subject to TikTok's Terms of Service and Community Guidelines. Privacy level, comment, duet and stitch settings are the ones you select before publishing.

8. Acceptable use

You may not use the Services to:

• Violate law, regulation, court order, or another person's rights.
• Access, connect, monitor, or publish to an account without authorization.
• Upload malware, malicious code, or content intended to disrupt or compromise the Services.
• Circumvent security, access controls, subscription limits, rate limits, or usage restrictions.
• Scrape, reverse engineer, probe, or exploit the Services except where applicable law expressly permits it.
• Generate or distribute unlawful, fraudulent, deceptive, defamatory, harassing, hateful, sexually exploitative, or violent content.
• Impersonate another person or misrepresent affiliation, endorsement, results, or identity.
• Infringe copyright, trademark, privacy, publicity, confidentiality, or other rights.
• Use the Services for spam, coordinated inauthentic behavior, platform manipulation, fake engagement, or prohibited automation.
• Resell, sublicense, or provide unauthorized access to the Services.

We may investigate suspected violations and remove content, restrict features, suspend accounts, or terminate access when reasonably necessary to protect the Services, users, third parties, or legal compliance.

9. FeedFuel intellectual property

The Services, including FeedFuel's software, interfaces, branding, designs, documentation, and non-user content, are owned by Amplifye or its licensors and are protected by intellectual-property laws.

Subject to these Terms and your applicable subscription, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. No other rights are granted.

If you provide feedback or suggestions, you grant us permission to use them without restriction or compensation, provided we do not identify you publicly without permission.

10. Third-party services

The Services depend on or link to third-party products, including Instagram and Meta, TikTok, Apple, Google, Firebase, RevenueCat, Stripe, Supabase, OneSignal, Sentry, AI providers, and hosting providers. We do not control those services and are not responsible for their availability, content, security, or independent practices.

Your use of a third-party service remains subject to its own terms and policies. If you download FeedFuel from the Apple App Store, Apple's Standard End User License Agreement applies to the licensed application unless a valid custom license agreement is presented in App Store Connect. App-store terms control store billing and distribution matters where they conflict with these Terms.

11. Privacy

Our Privacy Policy explains how we collect, use, disclose, and retain information. By using the Services, you acknowledge those practices.

You may disconnect Instagram through Meta or TikTok through your TikTok account settings, and request account deletion in the mobile app through Profile → Account → Delete account, or by emailing support@feedfuel.app from your account email. Web users do not need the mobile app to request deletion. Mobile subscription cancellation is handled separately through Apple or Google; web packs do not renew.

12. Suspension and termination

You may stop using FeedFuel at any time. You may request deletion through the in-app control or support@feedfuel.app. Deleting an individual web carousel removes it from the library and schedules generated revisions for cleanup; shared uploads and limited retained records are addressed separately in the Privacy Policy.

We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, fail to pay applicable fees, misuse third-party services, or if we are required to do so by law or a platform provider.

After termination, provisions that by their nature should survive will remain in effect, including provisions concerning ownership, payment obligations, disclaimers, limitations of liability, indemnification, and dispute terms.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." FEEDFUEL AND AMPLIFYE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.

WE DO NOT WARRANT THAT THE SERVICES OR GENERATED OUTPUT WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, UNIQUE, ACCURATE, OR SUITABLE FOR YOUR PURPOSE, OR THAT CONTENT WILL PUBLISH AT A PARTICULAR TIME OR PRODUCE A PARTICULAR BUSINESS OR AUDIENCE RESULT.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMPLIFYE, FEEDFUEL, AND THEIR OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR FAILED OR DELAYED PUBLICATION, ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FEEDFUEL FOR THE SERVICES, INCLUDING WEB PURCHASES, DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be limited.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Amplifye, FeedFuel, and their officers, employees, contractors, affiliates, and licensors from claims, losses, liabilities, and expenses, including reasonable legal fees, arising from Your Content, your use of the Services, your violation of these Terms, or your violation of another person's rights.

This section does not apply where prohibited by consumer law.

16. Disputes and your legal rights

If you have a concern, contact support@feedfuel.app so we can try to resolve it. This does not require you to delay a claim or prevent you from using a court, regulator, small-claims process or other remedy available under applicable law.

These Terms do not exclude or override mandatory consumer protections, applicable privacy rights, or rights to bring proceedings in a court available to you under applicable law. No exclusive court or arbitration requirement is imposed by this section.

17. Changes to the Services or Terms

We may update the Services and these Terms. If we make a material change, we will provide notice as required by law, such as through the app, website, or email. The updated Terms will state their effective date.

If you continue using the Services after updated Terms take effect, you agree to the updated Terms. If you do not agree, stop using the Services and cancel any subscription through the applicable app store.

18. General terms

These Terms and the Privacy Policy form the agreement between you and Amplifye concerning the Services, together with any purchase terms shown at checkout. If a provision is unenforceable, it will be modified only to the extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, reorganization, or sale of assets. Headings are for convenience only.
